MMR Gets the Nod from California Superior Court


MyMedicalRecords (MMR) recently got a nod from the Superior Court in California to proceed with collecting $30 million from Surgery Center Management (SCM). In fact, the court ordered that SCM should respond to MMR's complaint within ten days.

MMR is a company involved in providing a safe and secure way to store and access personal health records online. It offers a storage deposit box for customers and makes it easy for them to share this information with authorized personnel such as their healthcare providers. Surgery Center Management, on the other hand, provides business management services to centers engaged in medical practice and surgery.

This case is based on a Non Exclusive Settlement and Patent Agreement entered into by MMR and SCM on December 9, 2011. According to the terms of this agreement, SCM was willing to pay an initial amount of five million dollars and subsequently, five million dollars per year for the next five years to license MMR's Personal Health Records Patent.

On January 19, 2012, MMR filed a case in California's Superior Court located in the district of Los Angeles for breach of agreement. As per the case, MMR sought $30 million in damages from SCM for violating the terms of the agreement. To get legal counsel in this case, MMR hired the law firm of Liner Grode SteinYankelevitz Sunshine Regenstrief and Taylor. On July 1, 2013, SCM filed an appeal in the Second Appellate Division, Second District. However, the court dismissed the case without even hearing any oral argument from either of the parties. Following this dismissal, the nod from the Superior Court puts MMR in the driver's seat when it comes to the relationship between the two companies.

After this decision, MMR is ready to proceed to collect its dues from SCM. The company's executives are thrilled with this decision.
